These Terms govern your access to and use of Coolify and its associated services. By accessing or using Coolify, you agree to be bound by these Terms. Coolify is designed for binary analysis and informational purposes only. The software does not provide investment advice, recommendations, or endorsements. Any information provided by Coolify should not be construed as financial advice or a recommendation to buy or sell any securities or financial instruments. Users are solely responsible for their trading decisions and should independently verify and assess the suitability of any trades or strategies.

3. User Obligations

a. Eligibility: By using Coolify, you represent and warrant that you are of legal age to enter into a binding agreement and are legally permitted to use the services offered by Coolify.

b. Account Security: You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify Coolify immediately of any unauthorized use of your account or any other breach of security.

c. Prohibited Activities: You agree not to use Coolify for any illegal or unauthorized purpose. You must not engage in activities that may disrupt, damage, or impair the functionality of Coolify or interfere with other users' access to the software.

4. Intellectual Property

a. Ownership: Coolify, including its software, documentation, logos, and any associated materials, is protected by intellectual property laws and regulations. All rights, titles, and interests in Coolify are owned by Coolify or its licensors.

b. Restrictions: Users may not modify, copy, reproduce, distribute, or create derivative works from Coolify's materials without the prior written consent of Coolify. Unauthorized use of Coolify's intellectual property may result in legal action.

5. Illegal Distribution

The distribution of Coolify, including its software, documentation, or any related materials, without explicit authorization from Coolify is illegal and strictly prohibited. Unauthorized distribution, copying, or dissemination of Coolify’s materials may result in legal action, including but not limited to criminal prosecution and civil penalties.

6. Disclaimers and Limitation of Liability

a. No Warranty: Coolify is provided "as is" without any warranties, representations, or guarantees of any kind, either express or implied. Coolify disclaims all warranties, including but not limited to the accuracy, reliability, and fitness for a particular purpose of the software and its analysis.

b. Limitation of Liability: To the maximum extent permitted by law, Coolify and its affiliates, directors, officers, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use or inability to use Coolify, including but not limited to trading losses, data loss, or financial damages. In no event shall Coolify’s total liability exceed the amount paid by you, if any, for accessing the software.

7. Indemnification

You agree to indemnify, defend, and hold harmless Coolify, its affiliates, directors, officers, employees, and agents from any claims, losses, liabilities, damages, costs, and expenses (including legal fees) arising out of or related to your use or misuse of Coolify, or any violation of these Terms.

8. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Kenya. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya. You agree to submit to the personal jurisdiction of the courts located in Kenya for any legal proceedings arising out of these Terms.

9. Changes to Terms

Coolify reserves the right to modify or revise these Terms at any time without prior notice. Any changes will be effective immediately upon posting on our website. It is your responsibility to review these Terms periodically for any updates. Continued use of Coolify following any modifications constitutes your acceptance of the revised Terms.

10. Termination

Coolify reserves the right to terminate or suspend your access to the software at any time, with or without cause, and with or without notice. Upon termination, your right to use Coolify will cease, and you must immediately stop using the software.

14. No Waiver

The failure of Coolify to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision.
